Will Dredgers ever get back into the water in California?

In what can only be seen as bizarre turn of events, yesterday miners seem to have lost most of the ground they’ve gained in the six-year legal battle to end the ban on suction dredge mining in California.

California Superior Court Judge Gilbert Ochoa denied a proposed injunction intended to allow dredgers back in the water. Ochoa stated that in his opinion the miners have suffered under the ban but not enough harm to warrant injunctive relief.

Ochoa wrote in his tentative ruling that because the People v. Brandon Reinhart appellate decision has been “de-published” and the case has reached the California Supreme Court, that his own ruling on federal preemption in favor of miners in January is now also up for review.

Miners argue that the “two-year dredging moratorium” imposed by the state in 2009, has dragged on for six years and is no longer a moratorium but an outright ban that violates that rights of miners under the Mining Law of 1872 as well as the Supremacy Clause of the Constitution.

Attorneys for Public Lands for the People, New ’49ers and Western Mining Alliance contend that the financial losses as well as the state’s continuing violations of congressionally granted and constitutional rights is “irreparable harm.”

“Justice delayed is justice denied,” said PLP President Walt Wegner.

Mining rights groups, including PLP, New 49ers and WMA, are now developing an appeal strategy, Wegner said.

A trial has now been set for Jan. 20, 2016 to conclude the dredging ban cases that remain before Ochoa.

That state needs money so bad but they shot them self in the foot. The ones that live in the state and us that don't are willing to come there spending our money buying gas and other supplies dredging. They will let us back in when all are standing on the street with a sign saying WORK FOR FOOD.

To think I started prospecting for gold along the 49'ers trail back in 61. When I got out of the Air Force in 65 I wanted to go back and live there. All knows that when married what you want and what she wants may not be the same. She gone anyway and I'm still in Texas.Ha

Likely the Judge changed his mind about dredging because he was called to Sacramento by the Attorney General and was told to play ball with the state, or else they would come into the county and take over his cases. Causing him to maybe lose the next election and have to practice law again.

Whatever happened, doesn't change the fact 3 appellate court judges ruled the dredge moratorium is illegal.

I use to work for a superior court judge down on the Ventura county area.....he told me it's a good ole boys club, you scratch my back and I'll scratch yours. Boys if you think you have a Free country/ ruled by the rule of law....wake the S up and smell the roses.

Our country has been taken over by very , very smart people with a lot of money. Suction dredging is done and over in California...

Hey Guys,

The reason I'm asking for the most part, is the "language" is so confusing to me. I will read one article on one site about the dredging and it sounds promising, then another article and it sounds like they will never drop a dredge in the water. Not sure how it ever got to this point, but it's a sad situation. I honestly love to dredge and keep hearing about this "El Nino" each year that never arrives. They are now saying the weather patterns for 2015 are looking like the 1997 year, but have heard that several times, if not more in the last 10 years.

Yes, I know there are some rogue dredgers, I would probably be one of them. I don't like how it went down, especially if my income relied on gold dredging.

Fingers crossed that something will change in the future!

Ditto Grubstake, need a little civil unrest- protest. I love the club in N. Kali [ won't mention their names] at least have a dredge in to get some media buzz going !!!! There worried upsetting the apple cart per say. Millions of $$$$ Dollars spent trying to play nice, and the powers to be just laugh at us. Look's like there ain't going to be much of an apple cart left to upset if we keep playin their games. We have given up 2015 dredge season, now looking to save 2016 season. Gooood Luck Same results. Any one need a membership I may have mine for sale shortly. :ph34r::angry2:

Dredging is hard a.. work and anyone who has done it, knows that....

so I don't care if anyone or all of you out there dredge------

the statement above about breaking that "law," is not valid because is not a law---

I suppose the real question is...... do you believe in the Constitution and the Mining Laws already set up?

If you don't, then I can understand your line of thinking.....

And dredging hasn't got anything to do with "screwing" me or anyone else----personally---

I am all for anyone who has the guts and the gumption to get out there and get it on---- standing on the Laws that are already in place and have been for years.

By the way, I am not part of the "us" above.......

And lastly if that was written in jest and I didn't get it,,, I apologize.

Hey Guys,

My thoughts are guys have been dredging for over 100 years and mining that same ground for 150 years. Now all of a sudden someone decides it's not a good idea to dredge. We all know it's political crap, nothing to do with dredging harming wifelife, fish or anything along those lines.

It's a sad situation as I know several guys that relied on that income. All of us have various jobs, whether that's working at the grocery store to being a Doctor. Many incomes came from gold dredging and economy around it. Many small Mom & Pop stores have struggled or closed down since dredging stopped.

The stoppage of dredging didn't just hurt the dredgers themselves, but many others that relied on full-time and seasonal dredgers in their area.

I love dredging ..... nothing like seeing that color on the bedrock!

Well a lot of this comes from nothing but jealousy. People have no desire to go prospect for gold, but they don't want you to get it either.

After all, if they allow you to dredge for gold, all of the gold will be gone for future generations, and then they will have nothing to ban future generations from doing.

This is all too reminiscent of the Abalone fishery closing in California. They fish and game said they would only close the taking of abalone for 2 years to sports scuba divers, just to let the population grow. Then they extended it for two more years. Then a few more, then indefinitely. So it has been over 20 years since I have been able to take Abalone off the cost of Santa Barbara.

It's called incrementalism. It is a favorite tactic of the liberals. Just lie and make people believe it will only be for a little while. Then once the law is in place just shut it down.

Anytime any governmental agency just wants a temporary closure, or restriction on anything, JUST SAY NO.

The United States Government has a history of hoarding land and land closures in the west. Its not about mining, it is totally about people control. These are the same idiots that passed the 18th amendment.

Elections have consequences be sure you want your guy to win before you vote for another traitor, look at the embarrassment in the white house now, someone voted for that.
